1. Who we are
LicensedAndInsured.com (“we,” “us,” the “Service”) is operated by [ENTITY NAME — e.g. Thriving Partners, LLC], a Florida limited liability company. We are an independent, privately operated business. We are not a government agency, not affiliated with any licensing board, and not authorized to issue, grant, revoke, or interpret any government license or credential.
These terms form a binding agreement between you and us when you purchase verification. If you are agreeing on behalf of a business, you represent that you are authorized to bind that business.
2. What the service is
For an annual fee, we perform a point-in-time review of publicly available licensing records and of documents you supply, and if the review is satisfactory we publish a dated verification page and issue a badge kit. Specifically, we:
- check the status of your license or registration in the official state (or, where applicable, local) public record on a stated date;
- check that the licensed name corresponds to the business name you market under;
- review a certificate of insurance you provide showing general liability coverage, and workers’ compensation coverage where applicable, recording carrier, limits, and policy dates;
- publish a verification page showing what was checked and the date it was checked; and
- repeat the review approximately twice per year while your subscription is active.
3. What verification does not mean
Verification is a record of what we checked and when. It is not a guarantee about the future, an opinion about quality, or an endorsement.
Specifically, verification is not:
- a guarantee that your license or insurance remains valid or in force at any time after the stated check date — policies can be cancelled and licenses can lapse or be suspended at any moment;
- a guarantee, warranty, or prediction regarding workmanship, pricing, scheduling, safety, or the outcome of any project;
- an endorsement, recommendation, referral, or certification of you or your business;
- a government credential, or a substitute for a homeowner’s own verification with the issuing agency and insurer;
- legal advice, insurance advice, or advice regarding coverage adequacy. We do not sell, solicit, negotiate, or advise on insurance.
We encourage every homeowner to independently confirm license and insurance status with the issuing agency and the insurance agent before hiring anyone, including a verified contractor. Our website says so publicly.
4. Your obligations
- Accurate information. The company name, license or registration number, state, and contact details you provide must be accurate, current, and yours.
- Genuine documents. Certificates of insurance you send must be authentic, unaltered, and issued for the business being verified.
- Ongoing compliance. You must maintain the license and insurance that formed the basis of your verification for as long as you display the badge.
- Prompt notice. You must notify us within ten (10) days if your license or registration lapses, is suspended, is revoked, or is subject to disciplinary action, or if your insurance is cancelled or non-renewed.
- Honest use. You may not describe verification as a government approval, a guarantee of your work, an endorsement, or a form of insurance coverage.
Submitting false or altered documents is grounds for immediate termination without refund, and we may report suspected fraudulent licensing or insurance documents to the relevant licensing board, insurer, or authorities.
5. Fees, renewal, and cancellation
Automatic renewal. Verification is sold as an annual subscription. Your card is charged the then-current fee at purchase and automatically charged the same amount once every twelve (12) months on the anniversary of your purchase, until you cancel.
Cancel anytime. There is no contract, no minimum term, and no cancellation fee. You may cancel at any time using the billing link on your receipt or by emailing us. We will send a renewal reminder before each annual charge.
Founding-member pricing, where offered, is honored at the stated rate on each renewal for as long as your subscription remains continuously active. If you cancel and later re-subscribe, the then-current standard rate applies.
Cancellation stops future charges. It does not retroactively refund the term already paid for. Your verification page and badge rights remain active through the end of the paid term and then end.
6. Refund policy
- If you do not pass verification, you receive a full refund. If we cannot verify your license or insurance, we refund your payment in full and tell you what did not clear.
- Thirty-day satisfaction refund. If you change your mind within thirty (30) days of your initial purchase, contact us for a full refund of that initial payment.
- Renewals. If you are charged a renewal you did not intend, contact us within thirty (30) days of the charge and we will refund it and cancel the subscription.
- Refunds are not available where verification was obtained using false or altered documents.
7. Badge license
While your subscription is active and your verification is current, we grant you a limited, non-exclusive, non-transferable, revocable license to display the LicensedAndInsured.com verification badge on your website, vehicles, signage, proposals, and marketing materials.
- You may not alter the badge’s colors, wording, or year.
- You may not sublicense, sell, or share badge files with any other business.
- Web display must link to your verification page.
- You must stop displaying the badge and remove it from all materials, including physical materials, within thirty (30) days of cancellation, non-renewal, or withdrawal of verification.
All trademarks, badge designs, and site content remain our property.
8. Suspension and withdrawal
We may suspend or withdraw verification and remove your page at any time, with notice where practicable, if your license or insurance lapses or is cancelled, if information you supplied proves inaccurate, if you misuse the badge or misrepresent what verification means, or if we determine in good faith that continued verification would be misleading to the public. Withdrawal for these reasons does not entitle you to a refund of the current term.
9. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that public records we consult are accurate, complete, or current — those records are maintained by third parties and government agencies, not by us.
10. Limitation of liability
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount of fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or reputational harm, even if advised of the possibility.
Nothing in these terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless [ENTITY NAME] and its members, managers, officers, and agents from any claim, loss, or expense (including reasonable attorneys’ fees) arising from information or documents you supplied, your use or misuse of the badge, your work for customers, or your breach of these terms.
12. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to that jurisdiction and venue. Before filing, both parties agree to attempt in good faith to resolve the dispute by direct discussion for thirty (30) days.
13. Changes to these terms
We may update these terms. If we make a material change, we will notify active subscribers by email at least thirty (30) days before it takes effect. Changes to fees never apply to a term already paid for. Continuing your subscription after the effective date means you accept the updated terms.
